GENERAL TERMS AND CONDITIONS OF SALE<\/strong><\/p>\n

1. Application, enforceability and definitions<\/strong><\/h2>\n

All purchases made from BODY TRAINING STUDIO are final (except for online registrations). See below.<\/p>\n

BODY TRAINING STUDIO does not offer refunds on services or products in the event of a change of mind, injury, illness, change of address, or for any other reason.<\/p>\n

Membership fees may be increased once per year, on January 1st, by a maximum of 10%. If this increase takes effect, it does not give the right to terminate the contract, unless the increase in the membership fee occurs within three months following the conclusion of the contract.<\/p>\n

If the purchase of the membership requires installment payments, the applicant agrees to approve these payments by credit or debit card on the dates specified in advance in the contract.<\/p>\n

All memberships are personal and non-transferable.<\/p>\n

Memberships cannot be shared. Any person caught sharing a membership will be denied access and will permanently lose their membership.<\/p>\n

BODY TRAINING STUDIO reserves the right to suspend the member’s membership until the negative balance of the member’s account with BODY TRAINING STUDIO is settled.<\/p>\n

To register or purchase on BODY TRAINING STUDIO’s online booking system and attend regular classes, one must be over sixteen (16) years of age.<\/p>\n

The agreements are for a fixed term and are tacitly renewed for the same duration in the absence of termination by registered letter at least 30 days before the end date of the basic agreement (see below regarding the method of termination).<\/p>\n

1.1. Scope<\/strong><\/p>\n

These general terms and conditions (hereinafter “GTC”) govern all relations between Body Training Studio SRL (hereinafter “BTS”) and its clients (hereinafter “Member”), for any service, product, offer, order, contract or invoice, unless otherwise agreed in writing and signed by BTS.<\/p>\n

1.2. Acceptance<\/strong><\/p>\n

By registering, booking or purchasing a product\/service, the Member declares that they have read, understood and accepted without reservation the GTC and the Studio Rules. The applicable GTC are available on the BTS website.<\/p>\n

1.3. Modifications<\/strong><\/p>\n

BTS may amend the GTC at any time (legal compliance, service improvement). The applicable version is the one published on the website on the day of booking\/order.<\/p>\n

1.4. Exclusive cancellation channel (authenticity & traceability)<\/strong><\/p>\n

To guarantee the authenticity and traceability of operations, any cancellation of a session must be made exclusively through the official BTS mobile application. No cancellation is accepted by phone, e-mail, social media or at the front desk. Cancellations must comply with the deadlines set out in Article 5.<\/p>\n

1.5. Definitions<\/strong><\/p>\n

Membership: fixed-term contract giving access to sessions according to the chosen formula.<\/p>\n

Session: EMS class\/training session or scheduled Metabolism program.<\/p>\n

No-show: absence not cancelled within the deadlines.<\/p>\n

Mobile application: official BTS application allowing registration, booking and cancellation.<\/p>\n

Contract: agreement formed between BTS and the Member, including any digital signature.<\/p>\n

2. General provisions<\/strong><\/h2>\n

2.1. Personal nature<\/strong><\/p>\n

Memberships are personal and non-transferable. Sharing access is prohibited.<\/p>\n

2.2. Final purchase<\/strong><\/p>\n

All purchases are final, subject to the right of withdrawal for online registrations (Article 6).<\/p>\n

2.3. Adjustment of membership fees<\/strong><\/p>\n

Membership fees may be indexed once per year (max. 10% on January 1st). This indexation does not give the right to early termination, unless it occurs within 3 months following the signing.<\/p>\n

2.4. Installment payments<\/strong><\/p>\n

In the case of installments, the Member accepts the automatic direct debits provided for in the contract.<\/p>\n

2.5. Negative balance<\/strong><\/p>\n

Access to services may be suspended in the event of arrears until full payment, but not the payments themselves.<\/p>\n

2.6. Minimum age<\/strong><\/p>\n

Digital registration requires a minimum age of 16.<\/p>\n

2.7. Renewal<\/strong><\/p>\n

Fixed-term contracts are tacitly renewed at expiry, unless terminated by registered letter sent at least 30 days before the expiry date.<\/p>\n

2.8. Evidence & electronic<\/strong><\/p>\n

The Member accepts the evidentiary value of electronic confirmations (e-mails, receipts, application timestamps, digital signature).<\/p>\n

3. Membership formulas & service content<\/strong><\/h2>\n

3.1. Main formulas<\/strong><\/p>\n

12 months \u2013 \u20ac99 \/ 4 weeks (EMS or Metabolism)<\/p>\n

6 months \u2013 \u20ac179 \/ 4 weeks (EMS or Metabolism)<\/p>\n

12 months \u2013 \u20ac19 \/ 4 weeks (unlimited body analyses)<\/p>\n

3.2. Subscription<\/strong><\/p>\n

Via the BTS website with digital signature; or<\/p>\n

In the studio, assisted by a supervisor.<\/p>\n

3.3. Access & frequency<\/strong><\/p>\n

Access is exclusively by reservation through the application. For EMS, a minimum interval of 48 hours between two sessions is recommended for physiological reasons.<\/p>\n

3.4. Class modifications<\/strong><\/p>\n

BTS may adjust schedules, replace a coach, postpone or cancel a session, or limit access for operational, safety or force majeure reasons, without compensation (see Article 12 \u2013 Force majeure).<\/p>\n

4. Payments & incidents<\/strong><\/h2>\n

4.1. Methods<\/strong><\/p>\n

Payment by SEPA direct debit from registration, or bank card according to the options offered. The oldest debts are settled first.<\/p>\n

4.2. Payment failure<\/strong><\/p>\n

Administrative fees: \u20ac15 per reminder. In case of failure:<\/p>\n

(a) new attempt on the original card;<\/p>\n

(b) attempt on any other registered card;<\/p>\n

(c) failing this, suspension of access.<\/p>\n

4.3. Persistent default<\/strong><\/p>\n

BTS may entrust the file to a debt collection service and\/or terminate the contract, without prejudice to legally due collection costs and interest.<\/p>\n

4.4. Pricing error (online sales)<\/strong><\/p>\n

If a displayed price is manifestly incorrect, BTS will inform the Member and allow them to choose between confirming at the correct price or cancelling free of charge. As long as the Member’s instruction has not been received, the order will not be processed.<\/p>\n

5. Bookings, waiting lists and cancellations<\/strong><\/h2>\n

5.1. Prior booking & payment<\/strong><\/p>\n

Payment must be registered before the session. Booking is made via the application or website (consultation), but any cancellation is made exclusively via the mobile application (see 1.4).<\/p>\n

5.2. Booking window<\/strong><\/p>\n

Sessions open for booking up to 1 year before the scheduled time, subject to availability.<\/p>\n

5.3. Check-in & punctuality<\/strong><\/p>\n

The booking is guaranteed up to 5 minutes before the start. After this delay, the spot may be released for the benefit of a Member on the waiting list.<\/p>\n

5.4. Waiting list<\/strong><\/p>\n

If the waiting list is available, registration on the waiting list constitutes a commitment to participate. If a spot becomes available, the application automatically confirms your participation. If your plans change, remove yourself from the list in time via the application, failing which penalties may apply (see 5.6 – 5.7).<\/p>\n

5.5. Exclusive cancellation channel<\/strong><\/p>\n

For reasons of authenticity and traceability, cancellations must be made via the mobile application. No cancellation by e-mail, phone, social media, or at the front desk will be accepted.<\/p>\n

5.6. Standard cancellation deadline<\/strong><\/p>\n

Cancellation \u2265 4 hours before the session: free of charge. Cancellation < 4 hours: “late cancellation”.<\/p>\n

5.7. Consequences<\/strong><\/p>\n

Unlimited formulas: penalty of \u20ac8 per late cancellation or no-show.<\/p>\n

If the penalty cannot be debited, BTS will apply administrative fees: \u20ac15 per reminder and may suspend future bookings until payment.<\/p>\n

6. Right of withdrawal (online registrations)<\/strong><\/h2>\n

6.1. Deadline<\/strong><\/p>\n

For registrations made online, the Member has a right of withdrawal of 14 calendar days (Code of Economic Law \u2013 distance contracts).<\/p>\n

6.2. Procedure<\/strong><\/p>\n

Notification by e-mail to suspensions@bodytrainingstudio.be before the expiry of the deadline. BTS confirms receipt and processes the request in accordance with the law.<\/p>\n

6.3. Use during the deadline period<\/strong><\/p>\n

If services have been used during the 14 days, \u20ac50 per session will be invoiced and deducted from the amount to be refunded, where applicable.<\/p>\n

6.4. In-studio purchases<\/strong><\/p>\n

Sales made in the studio are final.<\/p>\n

7. Suspension, postponement and termination<\/strong><\/h2>\n

7.1. Suspension<\/strong><\/p>\n

No contractual suspension, except in exceptional and duly justified cases, only upon request by registered letter sent to the registered office. BTS reserves the right to accept or refuse the suspension.<\/p>\n

7.2. Early termination by the Member<\/strong><\/p>\n

Possible at any time by registered letter, with 30 days’ notice and payment of a lump-sum compensation of 3 months’ membership fee + \u20ac75 administrative fees in the first year. From the 2nd year onwards, with 30 days’ notice and payment of a lump-sum compensation of 2 months’ membership fee + \u20ac75 administrative fees.<\/p>\n

7.3. Termination by BTS<\/strong><\/p>\n

In the event of a serious breach of the GTC, fraud, repeated non-payment, dangerous or disrespectful behaviour, BTS may terminate immediately, without refund, without prejudice to damages, but applying a lump-sum compensation of 3 months’ membership fee + \u20ac75 administrative fees.<\/p>\n

8. Studio Rules (safety & etiquette)<\/strong><\/h2>\n

8.1. Hours & access<\/strong><\/p>\n

Access is permitted only during opening hours and for Members with a valid booking.<\/p>\n

8.2. Punctuality<\/strong><\/p>\n

Late arrivals and early departures are not permitted. Follow the coach’s instructions.<\/p>\n

8.3. Phones<\/strong><\/p>\n

Phones prohibited in the training rooms; leave them on silent mode in the changing rooms.<\/p>\n

8.4. Lockers & belongings<\/strong><\/p>\n

Individual changing rooms are made available during the session only. It is forbidden to leave personal belongings overnight. BTS declines all responsibility in case of loss\/theft.<\/p>\n

8.5. Lost and found<\/strong><\/p>\n

Items kept for 7 days at the “Lost & Found” front desk, then donated to a charity.<\/p>\n

8.6. Children & animals<\/strong><\/p>\n

Not allowed in training areas.<\/p>\n

8.7. Hygiene & equipment<\/strong><\/p>\n

Purchase of the Body Training Studio outfit is required at the price of \u20ac50.<\/p>\n

8.8. Behaviour<\/strong><\/p>\n

Any aggressive, discriminatory behaviour or behaviour contrary to safety rules will result in immediate exclusion.<\/p>\n

9. Health, contraindications & liability<\/strong><\/h2>\n

9.1. Anamnesis & information<\/strong><\/p>\n

Before any first session, the Member completes an anamnesis form and informs BTS of any health problems. BTS is not a medical service.<\/p>\n

9.2. Contraindications (non-exhaustive list)<\/strong><\/p>\n

Pacemaker or electronic implants, epilepsy, pregnancy (EMS), acute conditions, unhealed injuries, fever, unstabilised cardiac conditions, cancers under treatment, uncontrolled neurological disorders. The coach may refuse access as a precaution.<\/p>\n

9.3. Self-responsibility<\/strong><\/p>\n

The Member undertakes to listen to their body, follow instructions and stop in case of abnormal pain.<\/p>\n

9.4. Limitation of liability<\/strong><\/p>\n

Within the limits of applicable law, BTS’s liability is excluded for indirect damages, loss of profit, or loss\/theft of belongings, and may only be incurred in cases of gross fault or wilful misconduct. Nothing excludes the mandatory rights of the consumer.<\/p>\n

10. Intellectual property & image rights<\/strong><\/h2>\n

10.1. Content<\/strong><\/p>\n

Trademarks, logos, texts, photos, videos and training methods are protected. Any reproduction requires the written agreement of BTS.<\/p>\n

10.2. Recordings<\/strong><\/p>\n

Any recording for promotional purposes by BTS respects the right to one’s image and, where applicable, is done with consent.<\/p>\n

11. Personal data (GDPR)<\/strong><\/h2>\n

11.1. Data controller<\/strong><\/p>\n

Body Training Studio SRL.<\/p>\n

Purposes: Member management, bookings, payments, security, service improvement, anonymised statistics, operational communications and (where applicable) marketing with consent.<\/p>\n

11.2. Legal bases<\/strong><\/p>\n

Performance of the contract, legal obligations (accounting), legitimate interest (security\/anti-fraud), consent (marketing).<\/p>\n

11.3. GDPR rights<\/strong><\/p>\n

Access, rectification, erasure, restriction, portability, objection. Request via info@bodytrainingstudio.be. Complaints may be made to the Data Protection Authority (Belgium).<\/p>\n

11.4. Retention & security<\/strong><\/p>\n

Data is kept for the duration of the contract and then archived according to legal deadlines. Technical and organisational measures are in place. Data is neither sold, rented, nor exchanged.<\/p>\n

12. Miscellaneous provisions<\/strong><\/h2>\n

12.1. Force majeure<\/strong><\/p>\n

In the event of an unforeseeable and irresistible event (e.g. widespread network failure, administrative order, urgent works, epidemic, disaster), BTS may adjust the service (postponement, cancellation, temporary closure) without compensation. Reasonable alternatives may be proposed where possible.<\/p>\n

12.2. Partial invalidity<\/strong><\/p>\n

The invalidity of one clause does not affect the validity of the others. A valid clause with equivalent effect shall be deemed to replace the invalid clause.<\/p>\n

12.3. Non-waiver<\/strong><\/p>\n

The fact that BTS does not exercise a right does not constitute a waiver of the right to invoke it later.<\/p>\n

12.4. Assignment<\/strong><\/p>\n

BTS may assign the contract to an affiliated company or to a universal successor. The Member may not assign their contract without the written agreement of BTS.<\/p>\n

12.5. Language<\/strong><\/p>\n

In case of multilingual versions, the French version shall prevail in Belgium in the event of divergence.<\/p>\n

13. Applicable law & jurisdiction<\/strong><\/h2>\n

Belgian law exclusively.<\/p>\n

13.2. Competent jurisdiction<\/strong><\/p>\n

Failing an amicable agreement, any dispute shall fall under the jurisdiction of the Justice of the Peace of Brussels (or the legally competent jurisdiction), without prejudice to mandatory consumer protection provisions.<\/p>\n

5.2. Booking window. Sessions can be booked up to 1 year in advance, subject to availability.<\/strong><\/p>

5.3. Check-in and punctuality. The booking is guaranteed until 5 minutes before the start time. After this, the spot may be released to a Member on the waitlist.<\/strong><\/p>

Unlimited plans: \u20ac8 fee per late cancellation or no show.<\/strong><\/p>

If the fee cannot be collected, BTS will apply a \u20ac15 admin fee per reminder and may suspend future bookings until payment is received.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

6. RIGHT OF WITHDRAWAL (ONLINE REGISTRATIONS)\n\n\n\n\n\n\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t

6.1. Deadline. For online registrations, Members have a right of withdrawal of 14 calendar days (Consumer Code \u2013 distance contracts).<\/strong><\/p>

6.2. Method. Notice via email to suspensions@bodytrainingstudio.be before expiry of the deadline. BTS will acknowledge receipt and process the request in accordance with the law.<\/strong><\/p>

6.3. Use during the period. If services are consumed within 14 days, \u20ac50 per session will be charged and deducted from the refund.<\/strong><\/p>

6.4. In-studio purchases. In-studio sales are final.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

7. SUSPENSION, POSTPONEMENT AND TERMINATION\n\n\n\n\n\n\n\n\n\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t

7.1. Suspension. No contractual suspension except in exceptional and duly justified cases, requested only by registered letter to the registered office. BTS reserves the right to accept or refuse.<\/strong><\/p>

7.2. Early termination by the Member. Possible at any time by registered letter, with 30 days\u2019 notice and payment of a flat fee equal to 3 months\u2019 fees + \u20ac75 admin costs.<\/strong><\/p>

7.3. Termination by BTS. In case of serious breach of the T&Cs, fraud, repeated non-payment, dangerous or disrespectful behaviour, BTS may terminate immediately, without refund, without prejudice to damages, and applying a flat fee equal to 3 months\u2019 fees + \u20ac75 admin costs.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

8. STUDIO RULES (SAFETY AND ETIQUETTE)\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

8.1. Opening hours and access. Access is permitted only during opening hours and for Members with a valid booking.<\/strong><\/p>

8.2. Punctuality. Late arrivals or early departures are not permitted. Follow coach instructions.<\/strong><\/p>

8.3. Phones. Phones are prohibited in training rooms; keep them silent in lockers.<\/strong><\/p>

8.4. Lockers and belongings. Lockers are available only during the session. Leaving belongings overnight is prohibited. BTS is not liable for loss\/theft.<\/strong><\/p>

8.5. Lost property. Kept for 7 days at the \u201cLost & Found\u201d desk, then donated to charity.<\/strong><\/p>

8.6. Children and pets. Not permitted in training areas.<\/strong><\/p>

8.7. Hygiene and equipment. Purchase of the Body Training Studio outfit is mandatory at a price of \u20ac50.<\/strong><\/p>

8.8. Behaviour. Any aggressive, discriminatory or unsafe behaviour leads to immediate exclusion.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

9. HEALTH, CONTRAINDICATIONS AND LIABILITY\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

9.1. Medical history and disclosure. Before the first session, the Member completes a medical history form and informs BTS of any health issues. BTS is not a medical service.<\/strong><\/p>

9.2. Contraindications (non-exhaustive list). Pacemaker or electronic implants, epilepsy, pregnancy (EMS), acute conditions, unhealed injuries, fever, unstable heart disease, cancer under treatment, uncontrolled neurological conditions. The coach may refuse access as a precaution.<\/strong><\/p>

9.3. Own responsibility. The Member agrees to listen to their body, follow instructions and stop in case of abnormal pain.<\/strong><\/p>

9.4. Limitation of liability. Within the limits of applicable law, BTS is not liable for indirect damages, loss of profit, or loss\/theft of belongings, and can only be held liable in cases of gross negligence or wilful misconduct. Nothing excludes mandatory consumer rights.<\/strong><\/p><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

10.1. Content. Trademarks, logos, texts, photos, videos and training methods are protected. Any reproduction requires written consent from BTS.<\/strong><\/p>

10.2. Image rights. Any recordings for promotional purposes by BTS respect image rights and, if applicable, are subject to consent.<\/strong><\/p><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

11.1. Controller. Body Training Studio SRL.<\/strong><\/p>

Purposes: management of Members, bookings, payments, security, service improvement, anonymised statistics, operational communication and (if applicable) marketing with consent.<\/strong><\/p>

11.2. Legal basis. Performance of the contract, legal obligations (accounting), legitimate interest (security\/fraud), consent (marketing).<\/strong><\/p>

11.3. GDPR rights. Access, rectification, erasure, restriction, portability, objection. Requests via info@bodytrainingstudio.be. Complaints may be filed with the Data Protection Authority (Belgium).<\/strong><\/p>

11.4. Storage and security. Data is kept for the duration of the contract and then archived in accordance with legal timeframes. Technical and organisational measures are implemented. Data is not sold, rented or exchanged.<\/strong><\/p><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

12. MISCELLANEOUS PROVISIONS\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

12.1. Force majeure. In the event of an unforeseeable and unavoidable event (e.g. large-scale network failure, administrative order, urgent works, epidemic, disaster), BTS may adapt the service (postpone, cancel, temporarily close) without compensation. Reasonable alternatives may be proposed where possible.<\/strong><\/p>

12.2. Partial nullity. The nullity of one clause shall not affect the validity of the others. A valid clause with equivalent effect is deemed to replace the null one.<\/strong><\/p>

12.3. No waiver. Failure by BTS to exercise a right does not constitute a waiver of that right in the future.<\/strong><\/p>

12.4. Assignment. BTS may transfer the contract to an affiliated company or universal successor. The Member may not transfer their contract without BTS\u2019s written consent.<\/strong><\/p>

12.5. Language. In the event of multilingual versions, the English version shall prevail outside Belgium in case of conflict.<\/strong><\/p><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

13.1. Governing law. Belgian law only.<\/strong><\/p>

13.2. Jurisdiction.
