GENERAL TERMS AND CONDITIONS OF USE<\/strong><\/p>

1. Application, enforceability and definitions<\/strong><\/h2>

1.1. Scope.<\/strong> These general terms and conditions (hereinafter \u201cGTC\u201d) govern all relationships between Body Training Studio SRL (hereinafter \u201cBTS\u201d) and its customers (hereinafter \u201cMember\u201d), for any service, product, offer, order, contract or invoice, unless otherwise stipulated in writing and signed by BTS.<\/p>

1.2. Acceptance.<\/strong> By registering, booking or purchasing a product\/service, the Member declares that they have read, understood and accepted the GTC and the Studio Rules without reservation. The GTC in force are available on the BTS website.<\/p>

1.3. Amendments.<\/strong> BTS may amend the GTC at any time (legal compliance, service improvement). The enforceable version is the one published on the website on the day of the booking\/order.<\/p>

1.4. Exclusive cancellation channel (authenticity & traceability).<\/strong> To guarantee the authenticity and traceability of operations, any cancellation of a session must be made exclusively via the official BTS mobile app. No cancellation is accepted by telephone, e-mail, social media or at the front desk. Cancellation must comply with the deadlines indicated in Article 5.<\/p>

1.5. Definitions.<\/strong><\/p>

Membership:<\/strong> a fixed-term contract giving access to sessions according to the chosen plan.<\/p>

Session:<\/strong> an EMS training class\/session or a scheduled Metabolism programme.<\/p>

No-show:<\/strong> absence not cancelled within the deadlines.<\/p>

Mobile app:<\/strong> the official BTS app enabling registration, booking and cancellation.<\/p>

Contract:<\/strong> the agreement formed between BTS and the Member, including any digital signature.<\/p>

2. General provisions<\/strong><\/h2>

2.1. Personal nature.<\/strong> Memberships are personal and non-transferable. Sharing access is prohibited.<\/p>

2.2. Firm purchase.<\/strong> All purchases are final, subject to the right of withdrawal for online registrations (Article 6).<\/p>

2.3. Adjustment of fees.<\/strong> Fees may be indexed once a year (max. 5 % on 1 January). This indexation does not give rise to a right of early termination, unless it occurs within 3 months following signature.<\/p>

2.4. Instalment payments.<\/strong> In the event of instalment payment, the Member accepts the automatic direct debits provided for in the contract.<\/p>

2.5. Negative balance.<\/strong> Access to the services may be suspended in the event of arrears until full payment. This suspension of access does not, however, suspend the Member\u2019s payment obligations, which remain due.<\/p>

2.6. Minimum age.<\/strong> Digital registration requires a minimum age of 16 years.<\/p>

2.7. Renewal.<\/strong> Fixed-term contracts are tacitly renewed at expiry, unless terminated by registered letter sent no later than 30 days before the expiry date.<\/p>

2.8. Evidence & electronic.<\/strong> The Member accepts the evidential value of electronic confirmations (e-mails, receipts, app timestamps, digital signature).<\/p>

3. Membership plans & content of the services<\/strong><\/h2>

3.1. Main plans.<\/strong><\/p>

12 months \u2013 \u20ac99 \/ 4 weeks (EMS or Metabolism)<\/p>

6 months \u2013 \u20ac149 \/ 4 weeks (EMS or Metabolism)<\/p>

12 months \u2013 \u20ac19 \/ 4 weeks (unlimited body analyses)<\/p>

20-session pack \u2013 \u20ac800 (i.e. \u20ac40 per session), valid for 12 months from purchase<\/p>

Single session (per unit) \u2013 \u20ac50 per session<\/p>

3.2. Subscription.<\/strong><\/p>

Via the BTS website with digital signature; or<\/p>

In the studio, assisted by a supervisor.<\/p>

3.3. Access & frequency.<\/strong> Access is exclusively by booking via the app. For EMS, a minimum interval of 48 h between two sessions is recommended\/advised for physiological reasons.<\/p>

3.4. Changes to classes.<\/strong> BTS may adjust schedules, replace a coach, move or cancel a session, or limit access for operational, safety or force majeure reasons, without compensation (see Article 12 \u2013 Force majeure).<\/p>

3.5. 20-session pack.<\/strong> The pack of 20 sessions at the price of \u20ac800 is valid for 12 months from the date of purchase. Sessions are counted per unit and booked\/cancelled via the mobile app under the same conditions as memberships (Article 5). Sessions not used by the end of the 12-month validity period expire and are neither refunded, nor carried over, nor extended.<\/p>

4. Payments & incidents<\/strong><\/h2>

4.1. Terms.<\/strong> Payment by SEPA direct debit upon registration, or bank card according to the options offered. The oldest debts are settled as a priority.<\/p>

4.2. Payment failure.<\/strong> Administrative fees: \u20ac15 per reminder. In the event of failure: (a) a new attempt on the original card; (b) an attempt on any other registered card; (c) failing that, suspension of access.<\/p>

4.3. Persistent default.<\/strong> BTS may entrust the file to a debt collection service and\/or terminate the contract, without prejudice to the legally due collection costs and interest.<\/p>

4.4. Price error (online sale).<\/strong> If a displayed price is manifestly incorrect, BTS will inform the Member and leave the choice between confirming at the correct price or cancelling free of charge. As long as the Member\u2019s instruction has not been received, the order is not processed.<\/p>

5. Bookings, waiting lists and cancellations<\/strong><\/h2>

5.1. Prior booking & payment.<\/strong> Payment must be recorded before the session. Booking is done via the app or the website (consultation), but any cancellation is done exclusively via the mobile app (see 1.4).<\/p>

5.2. Booking window.<\/strong> Sessions open for booking up to 1 year before the scheduled time, subject to availability.<\/p>

5.3. Check-in & punctuality.<\/strong> The booking is guaranteed until 5 minutes before the start. After this deadline, the place may be released for the benefit of a waiting Member.<\/p>

5.4. Waiting list.<\/strong> If the waiting list is available, registration on the waiting list constitutes a commitment to participate. When a place becomes available, the app automatically confirms your participation. If your plans change, remove yourself from the list in time in the app, failing which penalties may apply (see 5.6\u20135.7).<\/p>

5.5. Exclusive cancellation channel.<\/strong> For reasons of authenticity and traceability, cancellations are made exclusively via the mobile app. No cancellation by e-mail, telephone, social media or at the front desk will be accepted.<\/p>

5.6. Standard cancellation deadline.<\/strong> Cancellation \u2265 4 h before the session: free of charge. Cancellation < 4 h: \u201clate cancellation\u201d.<\/p>

5.7. Consequences.<\/strong><\/p>

Unlimited plans: penalty of \u20ac8 per late cancellation or no-show.<\/p>

If the penalty cannot be debited, BTS will apply administrative fees of \u20ac15 per reminder and may suspend future bookings until payment.<\/p>

6. Right of withdrawal (online registrations)<\/strong><\/h2>

6.1. Period.<\/strong> For registrations made online, the Member has a right of withdrawal of 14 calendar days (Code of Economic Law \u2013 distance contracts).<\/p>

6.2. Terms.<\/strong> Notification by e-mail to suspensions@bodytrainingstudio.be before the expiry of the period. BTS confirms receipt and processes the request in accordance with the law.<\/p>

6.3. Use during the period.<\/strong> If services were used during the 14 days, \u20ac50 \/ session will be charged and deducted from the amount to be refunded, where applicable.<\/p>

6.4. In-studio purchases.<\/strong> Sales made in the studio are final.<\/p>

7. Suspension, postponement and termination<\/strong><\/h2>

7.1. Suspension.<\/strong> No contractual suspension, except in exceptional and duly justified cases, solely upon request by registered letter addressed to the registered office. BTS reserves the right to accept or refuse the suspension.<\/p>

7.1 bis. Suspension for medical reasons.<\/strong> The membership may be temporarily suspended for medical reasons, under the following cumulative conditions:<\/p>

the suspension is granted for a minimum duration of fourteen (14) days and a maximum of three (3) months per period of twelve (12) months;<\/p>

the membership is extended by a duration equivalent to that of the suspension granted;<\/p>

the suspension is granted only upon presentation of a medical certificate;<\/p>

the suspension may have a retroactive effect of a maximum of fourteen (14) days before the date indicated on the medical certificate.<\/p>

7.2. Early termination by the Member.<\/strong> Possible at any time by registered letter, subject to 30 days\u2019 notice and the payment of a flat-rate indemnity calculated as follows, depending on the seniority of the contract:<\/p>

During the 1st year of commitment: 3 months\u2019 fees + \u20ac75 administrative charges.<\/p>

From the 2nd year of commitment (and beyond): 2 months\u2019 fees + \u20ac75 administrative charges.<\/p>

The indemnity is payable in a single instalment; the termination takes effect on the day the payment is received.<\/p>

7.3. Termination by BTS.<\/strong> In the event of a serious breach of the GTC, fraud, repeated non-payment, dangerous or disrespectful behaviour, BTS may terminate immediately, without refund and without prejudice to damages, by applying the flat-rate indemnity provided for in Article 7.2 (3 months\u2019 fees + \u20ac75 in the 1st year; 2 months\u2019 fees + \u20ac75 from the 2nd year).<\/p>

8. Studio Rules (safety & etiquette)<\/strong><\/h2>

8.1. Hours & access.<\/strong> Access is permitted only during opening hours and for Members with a valid booking.<\/p>

8.2. Punctuality.<\/strong> Late arrivals and early departures are not permitted. Follow the coach\u2019s instructions.<\/p>

8.3. Phones.<\/strong> Phones are prohibited in the training rooms; to be kept on silent mode in the changing rooms.<\/p>

8.4. Lockers & belongings.<\/strong> Individual changing rooms are made available during the session only. Leaving belongings overnight is prohibited. BTS declines all liability in the event of loss\/theft.<\/p>

8.5. Lost & found.<\/strong> Kept for 7 days at the \u201cLost & Found\u201d desk, then donated to a charity.<\/p>

8.6. Children & animals.<\/strong> Not admitted in the training areas.<\/p>

8.7. Hygiene & equipment.<\/strong> The purchase of the individual Body Training Studio training outfit is mandatory at the price of \u20ac50.<\/p>

8.8. Behaviour.<\/strong> Any aggressive, discriminatory behaviour or behaviour contrary to the safety rules results in immediate exclusion.<\/p>

9. Health, contraindications & liability<\/strong><\/h2>

9.1. Anamnesis & information.<\/strong> Before any first session, the Member completes an anamnesis and informs BTS of any health problem. BTS is not a medical service.<\/p>

9.2. Contraindications (non-exhaustive list).<\/strong> Pacemaker or electronic implants, epilepsy, pregnancy, acute conditions, non-consolidated injuries, fever, unstabilised cardiac pathologies, cancers under treatment, uncontrolled neurological disorders. The coach may refuse access as a precaution.<\/p>

9.3. Self-responsibility.<\/strong> The Member undertakes to listen to their body, follow the instructions and stop in the event of abnormal pain.<\/p>

9.4. Limitation of liability.<\/strong> Within the limits of applicable law, BTS\u2019s liability is excluded for indirect damage, loss of profit, or loss\/theft of belongings, and may be engaged only in the event of gross negligence or theft. Nothing excludes the consumer\u2019s mandatory rights.<\/p>

10. Intellectual property & image<\/strong><\/h2>

10.1. Content.<\/strong> Brands, logos, texts, photos, videos and training methods are protected. Any reproduction requires the written consent of BTS.<\/p>

10.2. Photography & filming.<\/strong> Any recording for promotional purposes by BTS respects image rights and, where applicable, is carried out with consent.<\/p>

11. Personal data (GDPR)<\/strong><\/h2>

11.1. Data controller.<\/strong> Body Training Studio SRL. Purposes: management of Members, bookings, payments, security, service improvement, anonymised statistics, operational communications and (where applicable) marketing with consent.<\/p>

11.2. Legal bases.<\/strong> Performance of the contract, legal obligations (accounting), legitimate interest (security\/anti-fraud), consent (marketing).<\/p>

11.3. GDPR rights.<\/strong> Access, rectification, erasure, restriction, portability, objection. Request via info@bodytrainingstudio.be. A complaint may be lodged with the Data Protection Authority (Belgium).<\/p>

11.4. Retention & security.<\/strong> Data kept for the duration of the contract and then archived in accordance with legal deadlines. Technical and organisational measures are implemented. Data is neither sold, rented nor exchanged.<\/p>

12. Miscellaneous provisions<\/strong><\/h2>

12.1. Force majeure.<\/strong> In the event of an unforeseeable and irresistible event (e.g. widespread network outage, administrative order, urgent works, epidemic, disaster), BTS may adapt the service (postponement, cancellation, temporary closure) without compensation. Reasonable alternatives may be offered where possible.<\/p>

12.2. Partial invalidity.<\/strong> The invalidity of a clause does not affect the validity of the others. A valid clause of equivalent effect shall be deemed to replace the invalid clause.<\/p>

12.3. No waiver.<\/strong> The fact that BTS does not exercise a right does not constitute a waiver of the right to invoke it later.<\/p>

12.4. Assignment.<\/strong> BTS may assign the contract to an affiliated company or a universal successor. The Member may not assign their contract without the written consent of BTS.<\/p>

12.5. Language.<\/strong> In the event of multilingual versions, the French version prevails in Belgium in case of divergence.<\/p>

13. Applicable law & jurisdiction<\/strong><\/h2>

13.1. Applicable law.<\/strong> Exclusively Belgian law.<\/p>

13.2. Competent jurisdiction.<\/strong> Failing an amicable agreement, any dispute falls under the Justice of the Peace of Forest (or the legally competent court), without prejudice to the mandatory provisions protecting the consumer.<\/p>

5.1. Advance booking and payment. Payment must be recorded before the session. Bookings are made via the app or website (for viewing), but cancellations are made exclusively via the mobile application (see 1.4).<\/strong><\/p>

5.2. Booking window. Sessions can be booked up to 1 year in advance, subject to availability.<\/strong><\/p>

5.3. Check-in and punctuality. The booking is guaranteed until 5 minutes before the start time. After this, the spot may be released to a Member on the waitlist.<\/strong><\/p>

5.4. Waitlist. If available, joining the waitlist constitutes a commitment to attend. If a spot becomes available, the app automatically confirms attendance. If plans change, Members must remove themselves from the list in time; otherwise, penalties may apply (see 5.6 and 5.7).<\/strong><\/p>

5.5. Exclusive cancellation channel. For authenticity and traceability, cancellations are only accepted via the mobile application. No cancellations are accepted by email, phone, social media or at reception.<\/strong><\/p>

5.6. Standard cancellation deadline. Cancellation \u2265 4 hours before the session: free. Cancellation < 4 hours: \u201clate cancellation\u201d.<\/strong><\/p>

5.7. Consequences.<\/strong><\/p>

Unlimited plans: \u20ac8 fee per late cancellation or no show.<\/strong><\/p>

6.1. Deadline. For online registrations, Members have a right of withdrawal of 14 calendar days (Consumer Code \u2013 distance contracts).<\/strong><\/p>

6.2. Method. Notice via email to suspensions@bodytrainingstudio.be before expiry of the deadline. BTS will acknowledge receipt and process the request in accordance with the law.<\/strong><\/p>

7.1. Suspension. No contractual suspension except in exceptional and duly justified cases, requested only by registered letter to the registered office. BTS reserves the right to accept or refuse.<\/strong><\/p>

7.2. Early termination by the Member. Possible at any time by registered letter, with 30 days\u2019 notice and payment of a flat fee equal to 3 months\u2019 fees + \u20ac75 admin costs.<\/strong><\/p>

7.3. Termination by BTS. In case of serious breach of the T&Cs, fraud, repeated non-payment, dangerous or disrespectful behaviour, BTS may terminate immediately, without refund, without prejudice to damages, and applying a flat fee equal to 3 months\u2019 fees + \u20ac75 admin costs.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

8.1. Opening hours and access. Access is permitted only during opening hours and for Members with a valid booking.<\/strong><\/p>

8.2. Punctuality. Late arrivals or early departures are not permitted. Follow coach instructions.<\/strong><\/p>

8.3. Phones. Phones are prohibited in training rooms; keep them silent in lockers.<\/strong><\/p>

8.4. Lockers and belongings. Lockers are available only during the session. Leaving belongings overnight is prohibited. BTS is not liable for loss\/theft.<\/strong><\/p>

8.5. Lost property. Kept for 7 days at the \u201cLost & Found\u201d desk, then donated to charity.<\/strong><\/p>

8.6. Children and pets. Not permitted in training areas.<\/strong><\/p>

8.7. Hygiene and equipment. Purchase of the Body Training Studio outfit is mandatory at a price of \u20ac50.<\/strong><\/p>

8.8. Behaviour. Any aggressive, discriminatory or unsafe behaviour leads to immediate exclusion.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

9.1. Medical history and disclosure. Before the first session, the Member completes a medical history form and informs BTS of any health issues. BTS is not a medical service.<\/strong><\/p>

9.2. Contraindications (non-exhaustive list). Pacemaker or electronic implants, epilepsy, pregnancy (EMS), acute conditions, unhealed injuries, fever, unstable heart disease, cancer under treatment, uncontrolled neurological conditions. The coach may refuse access as a precaution.<\/strong><\/p>

9.3. Own responsibility. The Member agrees to listen to their body, follow instructions and stop in case of abnormal pain.<\/strong><\/p>

9.4. Limitation of liability. Within the limits of applicable law, BTS is not liable for indirect damages, loss of profit, or loss\/theft of belongings, and can only be held liable in cases of gross negligence or wilful misconduct. Nothing excludes mandatory consumer rights.<\/strong><\/p><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

11.2. Legal basis. Performance of the contract, legal obligations (accounting), legitimate interest (security\/fraud), consent (marketing).<\/strong><\/p>

11.3. GDPR rights. Access, rectification, erasure, restriction, portability, objection. Requests via info@bodytrainingstudio.be. Complaints may be filed with the Data Protection Authority (Belgium).<\/strong><\/p>

11.4. Storage and security. Data is kept for the duration of the contract and then archived in accordance with legal timeframes. Technical and organisational measures are implemented. Data is not sold, rented or exchanged.<\/strong><\/p><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

12.1. Force majeure. In the event of an unforeseeable and unavoidable event (e.g. large-scale network failure, administrative order, urgent works, epidemic, disaster), BTS may adapt the service (postpone, cancel, temporarily close) without compensation. Reasonable alternatives may be proposed where possible.<\/strong><\/p>

12.2. Partial nullity. The nullity of one clause shall not affect the validity of the others. A valid clause with equivalent effect is deemed to replace the null one.<\/strong><\/p>

12.3. No waiver. Failure by BTS to exercise a right does not constitute a waiver of that right in the future.<\/strong><\/p>

12.4. Assignment. BTS may transfer the contract to an affiliated company or universal successor. The Member may not transfer their contract without BTS\u2019s written consent.<\/strong><\/p>

12.5. Language. In the event of multilingual versions, the English version shall prevail outside Belgium in case of conflict.<\/strong><\/p><\/div><\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
