IMPORTANT · TACIT RENEWAL AND APPLICABLE PRICE
Your fixed-term contract is tacitly renewed on its expiry date, unless you give notice of termination no later than 30 days before that date.
After tacit renewal, you may terminate the contract subject to a notice period of no more than two months.
Upon renewal, the price list published on the date of renewal applies automatically, without prior individual notice. The applicable price list is permanently available at www.bodytrainingstudio.be. If you do not wish the contract to be renewed, terminate it no later than 30 days before the expiry date (articles 2.7 and 3.8).
1. Scope, enforceability and definitions
1.1. Scope. These general terms and conditions (hereinafter the “GTC”) govern all relations between Body Training Studio SRL (hereinafter “BTS”) and its customers (hereinafter the “Member”), for any service, product, offer, order, contract or invoice, unless otherwise agreed in writing and signed by BTS.
1.2. Acceptance. By registering, booking or purchasing a product/service, the Member declares that they have read, understood and unreservedly accepted the GTC and the Studio Rules. The GTC in force are available on the BTS website.
1.3. Amendments. BTS may amend the GTC at any time (legal compliance, service improvement). The enforceable version is the one published on the website on the date of the booking/order, without prejudice to articles 2.7 and 3.8.
1.4. Entry into force and earlier contracts. These GTC enter into force on 1 September 2026. They apply to any contract concluded from that date onwards. Contracts concluded before 1 September 2026 remain subject to the pricing conditions subscribed to until their end date, in accordance with article 3.8.
1.5. Exclusive cancellation channel (authenticity & traceability). To guarantee the authenticity and traceability of transactions, any session cancellation must be made exclusively through the official BTS mobile app. No cancellation is accepted by telephone, e-mail, social media or at the front desk. Cancellations must comply with the deadlines set out in article 5.
1.6. Definitions.
- Membership: a fixed-term contract giving access to sessions according to the plan chosen.
- Session: a scheduled EMS training class/session or Metabolism programme.
- 4-week period: the reference unit for billing and for the use of sessions. A contract year comprises 13 four-week periods. Billing is not monthly.
- Unlimited sessions: access to EMS sessions without any limit on their number over the term of the contract, subject to a limit of one session every 48 hours and to available time slots.
- Debit: the amount charged in each 4-week period in performance of the contract.
- VAT incl.: price including all taxes. The VAT rate applicable to memberships is 6%.
- Body composition analysis: measurement of body parameters (fat mass, muscle mass, distribution) carried out in the studio by a coach, as part of progress monitoring.
- No-show: an absence not cancelled within the applicable deadline.
- Mobile app: the official BTS application used for registration, booking and cancellation.
- Contract: the agreement formed between BTS and the Member, including any electronic signature.
2. General provisions
2.1. Personal nature. Memberships are personal and non-transferable. Sharing access is prohibited.
2.2. Firm purchase. All purchases are final, subject to the right of withdrawal for online registrations (article 6).
2.3. Adjustment of fees. Fees may be index-linked once a year (maximum 5% on 1 January). Such indexation does not give rise to a right of early termination, unless it occurs within 3 months of signature. The change to the price list on 1 September 2026 does not constitute indexation: it applies only to contracts concluded from that date onwards, and to contracts renewed under the conditions of article 3.8.
2.4. Instalment payments. In the case of payment by instalments, the Member accepts the automatic direct debits provided for in the contract, charged every 4 weeks.
2.5. Outstanding balance. Access to the services may be suspended in the event of arrears until payment in full. Such suspension of access does not, however, suspend the Member’s payment obligations, which remain due.
2.6. Minimum age. Online registration requires a minimum age of 16.
2.7. Tacit renewal and applicable price. Fixed-term contracts are tacitly renewed on their expiry date, unless terminated by registered letter sent no later than 30 days before that date. The renewed contract automatically takes the price of the price list in force on the date of renewal, without any prior individual notice being required. The Member acknowledges that the price list is permanently published on the BTS website and that it is for the Member to consult it before the expiry date. After tacit renewal, the Member may terminate at any time, subject to a notice period of no more than two months (article 7.7).
2.8. Evidence & electronic records. The Member accepts the evidential value of electronic confirmations (e-mails, receipts, app timestamps, electronic signature).
2.9. Display of prices. All prices communicated to the Member and set out herein are stated including VAT. Any change in the applicable VAT rate is automatically passed on to the VAT-inclusive price.
3. Plans, prices and content of services

All prices are stated including VAT. The VAT rate applicable to memberships is 6%.
3.2. Billing cycle
Billing takes place every 4 weeks and not monthly. A contract year comprises 13 four-week periods.
The debit is taken every 4 weeks throughout the term of the contract. The exact number of debits is stated in the contract signed by the Member.
3.3. Content of the membership plan
Each membership plan referred to in article 3.1 includes:
- unlimited EMS sessions with a personal coach, at a rate of one session every 48 hours (article 3.7);
- unlimited body composition analysis (article 3.4).
The unlimited nature means that there is no limit on the number of sessions over the term of the contract, subject only to the 48-hour interval between two sessions, the time slots open for booking and the capacity of the studio. Sessions not booked give rise to no carry-over, accumulation, credit, conversion or refund. Sessions are booked and cancelled in accordance with article 5.
3.4. Unlimited body composition analysis
The body composition analysis is carried out in the studio by a coach, by booking through the mobile app, subject to the available time slots and equipment. It is included without limit in the plans referred to in article 3.1. It constitutes a measurement of body parameters for sporting purposes and does not constitute a medical act or a diagnosis (article 9).
3.5. Other plans
- 20-session pack · 800,00 € VAT incl., valid for 6 months from the date of purchase. Sessions are deducted one by one and are booked/cancelled through the mobile app on the same terms as memberships (article 5). Sessions not used by the end of the 6-month validity period expire and are neither refunded, carried over nor extended.
- Single session (one-off) · 50,00 € VAT incl. per session.
These plans do not include the unlimited body composition analysis.
3.6. Subscription
- through the BTS website with electronic signature; or
- in the studio, assisted by a supervisor.
3.7. Access & frequency
Access is exclusively by booking through the mobile app. For physiological and safety reasons, a minimum interval of 48 hours must be observed between two EMS sessions. That interval constitutes the limit of the unlimited plan: the app does not allow an EMS session to be booked within 48 hours of the previous one. The coach may refuse a session where that interval is not observed or for any safety reason (article 9).
3.8. Contracts concluded before 1 September 2026
a) Existing conditions maintained. No current contract is amended by the entry into force of the new price list. Members whose contract was concluded before 1 September 2026 retain their pricing conditions and the service content subscribed to until the end of their contract.
b) Voluntary switch. A Member who wishes to benefit immediately from the plan referred to in article 3.1 may request this at any time. Their current contract is then terminated without notice, without charge and without any indemnity within the meaning of article 7.5, and a new contract is concluded on the terms of article 3.1.
c) Application upon renewal. On the expiry date of the contract, tacit renewal takes effect automatically at the price of the price list in force on the date of renewal, in accordance with article 2.7. This may only occur upon renewal, never during the term of the contract.
3.9. Organisation of sessions and studios
Sessions are accessible by booking only, subject to the availability displayed in the mobile app. No time slot, no schedule and no recurring booking is guaranteed, availability varying according to attendance, capacity and the organisation specific to each studio.
The Member may book sessions at any studio in the Body Training Studio network, subject to the availability of the studio concerned.
BTS may adjust schedules, replace a coach, move or cancel a session, change the timetable or temporarily restrict access for operational, organisational, safety or force majeure reasons. Such adjustments give rise to no indemnity, refund or extension of the contract, the Member retaining the option of booking another session or another studio under the conditions of this article (article 12.1 · Force majeure).
4. Payments & incidents
4.1. Payment methods. Payment by SEPA direct debit from registration, or by bank card according to the options offered. Debits are taken every 4 weeks. The oldest debts are settled first.
4.2. Failed payment. Administrative fee: 15 € per reminder. In the event of failure: (a) a further attempt on the original card; (b) an attempt on any other registered card; (c) failing which, suspension of access.
4.3. Persistent default. BTS may refer the file to a debt collection service and/or terminate the contract, without prejudice to the collection costs and interest legally due.
4.4. Pricing error (online sales). If a displayed price is manifestly incorrect, BTS informs the Member and offers the choice between confirming at the correct price or cancelling free of charge. Until the Member’s instruction is received, the order is not processed.
5. Bookings, waiting lists and cancellations
5.1. Prior booking & payment. Payment must be recorded before the session. Booking is made through the app or the website (consultation), but any cancellation is made exclusively through the mobile app (article 1.5).
5.2. Booking window. Sessions are open for booking up to 1 year before the scheduled time, subject to availability.
5.3. Check-in & punctuality. The booking is guaranteed until 5 minutes before the start. After that time, the place may be released to a Member on the waiting list.
5.4. Waiting list. Where a waiting list is available, registering on it constitutes a commitment to attend. If a place becomes available, the app automatically confirms the Member’s attendance. If plans change, the Member must withdraw from the list in the app in good time, failing which the penalties in articles 5.6 and 5.7 apply.
5.5. Exclusive cancellation channel. For reasons of authenticity and traceability, cancellations must be made through the mobile app. No cancellation by e-mail, telephone, social media or at the front desk will be accepted.
5.6. Standard cancellation deadline. Cancellation at least 4 hours before the session: free of charge. Cancellation less than 4 hours before the session: “late cancellation”. A session cancelled late or not attended starts a new 48-hour interval within the meaning of article 3.7.
5.7. Consequences.
- Any membership plan referred to in article 3.1: a penalty of 8 € per late cancellation or no-show.
- If the penalty cannot be debited, BTS will apply an administrative fee of 15 € per reminder and may suspend future bookings until payment.
6. Right of withdrawal (online registrations)
6.1. Period. For registrations made online, the Member has a right of withdrawal of 14 calendar days (Belgian Code of Economic Law · distance contracts).
6.2. Procedure. Notification by e-mail to suspensions@bodytrainingstudio.be before the expiry of the period. BTS confirms receipt and processes the request in accordance with the law.
6.3. Use during the period. If services have been used during the 14 days, 50 € per session will be charged and deducted from the amount to be refunded, where applicable.
6.4. In-studio purchases. Sales made in the studio are final.
7. Suspension, postponement and termination
7.1. Principle. The contract may not be suspended, except in the cases exhaustively provided for in articles 7.2 and 7.3. Any request for suspension must be sent by registered letter to the registered office or by e-mail to suspensions@bodytrainingstudio.be, together with supporting documents, before the desired effective date.
7.2. Suspension for pregnancy. In the event of pregnancy, the contract is suspended for a period of 10 months at the Member’s request accompanied by a medical certificate. The term of the contract is extended accordingly and debits are interrupted during the suspension, then automatically resume at its end.
7.3. Suspension for health incapacity. In the event of incapacity for health reasons, the contract may be suspended upon presentation of a medical certificate, for a minimum of 15 days and a maximum of 3 months, cumulated over the entire term of the contract. The term of the contract is extended accordingly and debits are interrupted during the suspension, then automatically resume at its end.
7.4. No termination for change of circumstances. The contract is concluded for a firm fixed term. After signature of the contract and acceptance of these GTC, no termination without indemnity will be granted on account of a change of circumstances arising subsequently, in particular a change in medical situation, incapacity, a move of residence, or a professional or family change. Such situations fall, as the case may be, under the suspensions provided for in articles 7.2 and 7.3. The Member retains the option to end the contract under the conditions of article 7.5.
7.5. Early termination by the Member. Possible at any time by registered letter, subject to 30 days’ notice and payment of a lump-sum indemnity calculated as follows, according to the seniority of the contract:
- during the 1st year of commitment: 3 months’ fee, i.e. the equivalent of 3 four-week debits, + 75 € administrative costs;
- from the 2nd year of commitment onwards: 2 months’ fee, i.e. the equivalent of 2 four-week debits, + 75 € administrative costs.
The indemnity is payable in a single instalment and its taking effect is governed by article 7.8. This article applies neither to the voluntary switch provided for in article 3.8 b), nor to termination after tacit renewal provided for in article 7.7.
7.6. Termination by BTS. In the event of a serious breach of the GTC, fraud, repeated non-payment, or dangerous or disrespectful behaviour, BTS may terminate immediately, without refund and without prejudice to damages, applying the lump-sum indemnity provided for in article 7.5.
7.7. Termination after tacit renewal. Where the contract has been tacitly renewed in accordance with article 2.7, the Member may end it subject to a notice period of no more than two months, given by registered letter or by any written form whose receipt can be established, without prejudice to article 7.8.
7.8. Effective date of termination. Whatever its cause · early termination (article 7.5), expiry of the agreed term or termination after tacit renewal (article 7.7) · the termination is only recorded subject to the dual condition that: (i) any lump-sum indemnity due has been credited in full to the BTS bank account; and (ii) any sum still owed by the Member on any basis whatsoever, in particular unpaid debits, late payments, penalties, administrative costs and collection costs, has been settled in full. The date on which the last payment is credited to the BTS bank account is authoritative and constitutes the effective date of termination. Until that date, the contract continues, the debits remain due and payable, and no termination request may be regarded as completed.
8. Studio Rules (safety & etiquette)
8.1. Opening hours & access. Access is permitted only during opening hours and to Members holding a valid booking.
8.2. Punctuality. Late arrivals and early departures are not permitted. The Member follows the coach’s instructions.
8.3. Lockers & belongings. Individual lockers are made available during the session only. Belongings may not be left overnight. BTS accepts no liability in the event of loss or theft.
8.4. Lost property. Kept for 7 days at the “Lost & Found” desk, then donated to a charity.
8.5. Animals. Not admitted in the training areas.
8.6. Hygiene & equipment. The purchase of the individual Body Training Studio training outfit is mandatory at a price of 50 € VAT incl.
8.7. Behaviour. Any aggressive or discriminatory behaviour, or behaviour contrary to the safety rules, results in immediate exclusion.
9. Health, contraindications & liability
9.1. Health questionnaire & information. Before any first session, the Member completes a health questionnaire and informs BTS of any health problem. BTS is not a medical service. The body composition analysis referred to in article 3.4 is a sports support service: it does not constitute a medical act, a diagnosis or a treatment, and does not exempt the Member from consulting a doctor.
9.2. Contraindications (non-exhaustive list). Pacemaker or electronic implants, epilepsy, pregnancy, acute conditions, unhealed injuries, fever, unstabilised cardiac conditions, cancers under treatment, uncontrolled neurological disorders. The coach may refuse access as a precaution.
9.3. Personal responsibility. The Member undertakes to listen to their body, comply with instructions and stop in the event of abnormal pain.
9.4. Sessions refused for health reasons. Where access to a session is refused by BTS on grounds of safety or contraindication, no penalty under article 5.7 is applied and the Member may book a new session without having to observe a further 48-hour interval.
9.5. Limitation of liability. Within the limits of applicable law, BTS’s liability is excluded for indirect damage, loss of profit, or loss/theft of belongings, and may only be engaged in the event of gross negligence or theft. Nothing excludes the consumer’s mandatory rights.
10. Intellectual property & image rights
10.1. Content. Trademarks, logos, texts, photographs, videos and training methods are protected. Any reproduction requires the written consent of BTS.
10.2. Filming and photography. Any recording for promotional purposes by BTS respects image rights and, where applicable, is carried out with consent.
11. Personal data (GDPR)
11.1. Data controller. Body Training Studio SRL. Purposes: management of Members, bookings, payments, monitoring of body composition analyses and sporting progress, security, service improvement, anonymised statistics, operational communications and, where applicable, marketing with consent.
11.2. Legal bases. Performance of the contract, legal obligations (accounting), legitimate interest (security/anti-fraud), consent (marketing and health data processed in the context of the health questionnaire and body composition analyses).
11.3. GDPR rights. Access, rectification, erasure, restriction, portability, objection. Requests via info@bodytrainingstudio.be. Complaints may be lodged with the Data Protection Authority (Belgium).
11.4. Retention & security. Data is retained for the term of the contract and then archived in accordance with statutory periods. Technical and organisational measures are in place. Data is neither sold, rented nor exchanged.
12. Miscellaneous provisions
12.1. Force majeure. In the event of an unforeseeable and irresistible event (e.g. a general network outage, administrative order, urgent works, epidemic, disaster), BTS may adapt the service (postponement, cancellation, temporary closure) without indemnity. Reasonable alternatives may be offered where possible.
12.2. Partial invalidity. The invalidity of one clause does not affect the validity of the others. A valid clause of equivalent effect shall be deemed to replace the invalid clause.
12.3. No waiver. The fact that BTS does not exercise a right does not constitute a waiver of its right to rely on it later.
12.4. Assignment. BTS may assign the contract to an affiliated company or to a universal successor. The Member may not assign their contract without the written consent of BTS.
12.5. Language. These GTC are available in French, Dutch, English and Spanish. In the event of any discrepancy between the versions, the French version prevails in Belgium.
13. Applicable law & jurisdiction
13.1. Applicable law. Belgian law exclusively.
13.2. Competent jurisdiction. Failing an amicable settlement, any dispute falls within the jurisdiction of the Justice of the Peace of Forest (or the legally competent court), without prejudice to mandatory consumer protection provisions.
